1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of MaziCard's website, applications, and services (collectively, the "Services"). These Terms constitute a legally binding agreement between you and MaziCard Technologies Private Limited ("MaziCard," "we," "us," or "our").

By creating an account, making a purchase, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

MaziCard provides a digital gift card platform that enables:

• Purchase and management of digital gift cards
• Gift card redemption at participating merchants
• Balance checking and transaction history
• Gift card sharing and transfers between users
• Merchant integration via our payment gateway API
• Real-time payment processing and settlement

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with or without notice.

3. User Accounts

3.1 Account Registration

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be at least 18 years old or the age of majority in your jurisdiction
• Not create accounts for fraudulent or illegal purposes

3.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach. MaziCard will not be liable for any loss arising from unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspected fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Services will immediately cease.

4. Gift Card Terms

4.1 Purchase and Activation

• Gift cards are activated upon successful payment confirmation
• Gift card values range from ₹100 to ₹50,000
• All purchases are final and non-refundable except as required by law
• Gift cards are not redeemable for cash unless required by applicable law

4.2 Validity and Expiration

• Gift cards are valid for 12 months from the date of purchase
• Expired gift cards cannot be reactivated or refunded
• We will send expiration reminders 30 days before expiry
• Unused balances on expired cards are forfeited

4.3 Redemption

• Gift cards can only be redeemed at participating merchants
• Partial redemption is allowed; remaining balance stays on the card
• If purchase exceeds card balance, you must pay the difference
• Merchants may have their own terms for gift card acceptance

4.4 Lost or Stolen Cards

Digital gift cards should be kept secure. MaziCard is not responsible for lost, stolen, or unauthorized use of gift cards. If you believe your card has been compromised, contact us immediately at support@mazicard.com.

5. Payments and Refunds

5.1 Payment Processing

All payments are processed through secure third-party payment providers (Razorpay). By making a purchase, you agree to the payment provider's terms of service. We accept major credit/debit cards, UPI, net banking, and other payment methods as displayed.

5.2 Pricing

All prices are displayed in Indian Rupees (INR) and include applicable taxes. We reserve the right to change pricing at any time without prior notice.

5.3 Refund Policy

• Gift card purchases are generally non-refundable
• Refunds may be issued for technical errors or duplicate charges
• Refund requests must be made within 7 days of purchase
• Approved refunds will be processed within 5-7 business days
• Refunds will be credited to the original payment method

6. Merchant Terms

Merchants using MaziCard's payment gateway API agree to additional terms:

• Complete KYC verification and maintain accurate business information
• Accept gift card payments without discrimination
• Not impose surcharges for gift card transactions
• Process refunds in accordance with your stated policy
• Maintain secure integration with our API
• Comply with PCI-DSS and applicable data protection regulations
• Pay agreed-upon transaction fees and settlement terms

MaziCard reserves the right to suspend merchant accounts for violations, excessive chargebacks, or suspected fraudulent activity.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for money laundering or terrorist financing
• Purchasing gift cards with stolen or fraudulent payment methods
• Reselling gift cards for profit without authorization
• Attempting to hack, reverse engineer, or compromise our systems
• Creating multiple accounts to abuse promotions or referral programs
• Impersonating others or providing false information
• Using automated systems to access our Services without permission
• Violating any applicable laws or regulations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAZICARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the changes becoming effective. Your continued use of the Services after the effective date constitutes your acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
